These Terms of Service ("Terms") govern access to and use of the Permbot website, APIs, dashboard, and consent widget (collectively, the "Service") provided by NOTTEC BİLİŞİM GÜVENLİK ELEKTRİK ELEKTRONİK İTHALAT İHRACAT SANAYİ TİCARET LİMİTED ŞİRKETİ.

By creating an account or using the Service, you agree to these Terms, our Privacy Policy, SaaS Agreement & SLA, and Data Processing Addendum (DPA) where applicable.

1. Eligibility and accounts

You must be at least 18 years old and have authority to bind your organization. You are responsible for safeguarding credentials and all activity under your account. Agency accounts may create client sub-accounts; you remain responsible for their authorized use.

2. The Service

Permbot is a consent management platform (CMP) that helps you display cookie/consent banners, record visitor choices, scan for cookies, and demonstrate compliance. Features depend on your plan. We may modify features with reasonable notice where practicable.

3. Acceptable use

Use the Service only for lawful purposes and in compliance with privacy laws applicable to your sites and visitors.
Do not upload malicious code, interfere with the Service, attempt unauthorized access, or overload infrastructure (including bots or scrapers without permission).
Do not reverse engineer, decompile, or attempt to extract source code except where law expressly permits.
Do not resell or sublicense the Service except as expressly allowed in agency plans.
Do not use the Service to collect sensitive categories of data without appropriate legal basis and safeguards.
You must obtain valid consent where required before firing non-essential tags through your configuration.

4. Your sites and data

You retain ownership of your site configurations and remain the data controller for end-user consent data. You grant us a limited license to host, process, and display data solely to provide the Service, including storing consent logs in the region you select (TR/EU isolation as described in our Privacy Policy).

5. Intellectual property

We own the Service, software, documentation, and trademarks. No rights are granted except as stated. Feedback may be used to improve the Service without obligation to you.

6. Third-party services

Integrations (analytics, tag managers, payment providers) are subject to their own terms. We are not responsible for third-party services you connect to your sites.

7. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security risk, or legal requirement. You may stop using the Service at any time. Provisions that by nature should survive (liability limits, IP, governing law) survive termination.

8. Disclaimers

The Service is provided "as is" except as expressly stated in the SaaS Agreement & SLA. We do not guarantee that your use of the Service alone ensures legal compliance; you are responsible for your privacy program and legal advice.

9. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages. Our aggregate liability arising from these Terms is limited to the fees you paid in the twelve (12) months before the claim, except for fraud, willful misconduct, or liability that cannot be limited by law.

10. Indemnification

You will defend and indemnify us against claims arising from your sites, your unlawful processing, or your breach of these Terms, except to the extent caused by our breach.

11. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules, unless mandatory consumer protections in your country require otherwise. Courts in Istanbul shall have exclusive jurisdiction, subject to mandatory law.

12. Changes

We may update these Terms. Continued use after notice constitutes acceptance of non-material changes. Material changes will be communicated via email or in-product notice.
